PUBLIC NOTICE OF PROPOSED WAIVER

DATE ISSUED: August 23, 2024

PROPOSED SERVICE: Structural Engineering Design Services for Retaining Wall Replacement

PROPOSED PROVIDER: Kimley-Horn and Associates, Inc.

REQUESTING DEPARTMENT: Engineering

Please take notice of Park City Municipal Corporation’s (PCMC’s) intent to waive a competitive 
procurement process. PCMC Procurement Rule 5-3 provides that the competitive procurement 
requirements may be waived under circumstances where there is a reasonable justification and the 
waiver is in the best interests of PCMC. The Procurement Official has determined that a waiver is 
appropriate for a contract for Structural Engineering Design Services for Retaining Wall Replacement in 
the amount of $89,700 to Kimley-Horn and Associates, Inc. based on the information below:

Waiver Justification: 
Awarding the contract through a Standard Procurement Process is impractical and not in the best 
interest of PCMC because procurement of the services is unlikely to produce competition.
The Marsac Retaining Wall Replacement Project presents significant risk to the City and users of the 
areas adjacent to the retaining wall. The existing, failed Marsac Retaining wall poses significant risk of 
substantial global failure if it were required to endure the stresses from water infiltration and freezethaw cycles during this upcoming winter. Schedule is seen as the most severe risk to this project. 
Kimley-Horn and Associates, Inc. performed a structural assessment on the wall previously this summer. 
As such, Kimley-Horn has significant and detailed understanding of the existing condition of the wall and 
other structural elements that would be impacted by the project work. They have spent time on site 
and have an increased familiarity with the constraints in the project area. They already have a 
relationship with the Geotechnical consultant who performed geotechnical testing on the soils at the 
wall, and as such, will not require additional contracting time to obtain further geotechnical services for 
the design of the wall. Due to the consultant’s knowledge and history working with this wall, they have 
committed to producing 30% structural plans within two weeks. The package they will produce for 30% 
will be sufficient to allow for demolition and construction to begin. Due to the risk of this project not 
being completed prior to winter, historical project knowledge and their commitment to producing plans 
within two weeks is invaluable in allowing the project to proceed as expeditiously as possible.

SCOPE OF SERVICES

Kimley-Horn will provide the services specifically set forth below.

 

Task 1: 30% Wall Structural Plans and Geotechnical Recommendations
 
Wall Structural Plans
  1. Prepare site-specific design criteria for the retaining wall based upon the local authority having jurisdiction.
  2. Coordinate with geotechnical engineer to obtain design recommendations for the retaining wall.
  3. Coordinate with the design team to determine final facing of wall, location of pedestrian barriers, property lines and limits of excavation, as required.
  4. Develop preliminary structural calculations for the retaining wall.
  5. Submit 30% construction documents in electronic PDF format for the retaining wall. Plans will indicate location of the new wall, approximate pile spacing and lagging information and approximate location of proposed guardrail behind the new wall. A sheet set is noted below:

     

    1. Cover Sheet
    2. General Note Sheet
    3. Plan and Elevation Sheet
    4. Typical Detail Sheet

                       

The deliverable for this task, is a set of 30% drawings, in 11x17 format, delivered electronically.

 

Geotechnical Recommendations

Kimley-Horn will retain a qualified and licensed geotechnical engineer subconsultant that provide the following scope:

 

  1. Geotechnical recommendations for a new soldier pile concrete lagging wall built in front of the existing retaining wall.
  2. Recommendations for excavation behind the existing concrete wall while protecting the existing soil nail anchors from the soldier pile wall.
  3. Geotechnical backfill recommendations.

 

The deliverable for this task is a geotechnical report with recommendations.

 

Task 2: 100% Wall Structural Plans
  1. Develop final structural calculations for the retaining wall.
  2. Coordinate with the Contractor on any field conditions that may impact the new wall layout and design.
  3. Attend one site visit to coordinate with the Client and Contractor in the development of the construction documents.
  4. Submit 100% construction documents in electronic PDF format for the retaining wall. Plans will indicate location of the new wall, final pile spacing and lagging information and location of proposed handrail behind the new wall.
  5. The following additional coordination items will be included in the deliverable:
    1. Relocation of electrical boxes, roadway signs and electrical conduits to be noted on the plans as items to be coordinated by the Contractor.
    2. Removal of an abandoned drilled shaft foundation at the start of the wall (south side).
    3. Removal and replacement of concrete slab sections that are damaged or that will be impacted within the scope of work.

    4. Demolition Plan
    5. Plan and Elevation Sheet

This task includes up to 20 hours of coordination calls or meetings with the Client and Contractor. It is assumed that the comments from the Contractor will not change the design intent or concept of the proposed wall. The deliverable for this task is a set of plans, in 11x17, signed and sealed, delivered electronically.

ADDITIONAL SERVICES

Any services not specifically provided for in the above scope will be billed as additional services and performed at our then current hourly rates. Additional services we can provide include, but are not limited to, the following:

 

  1. Completing permit related services.
  2. Construction Administration
  3. Structural Calculations
  4. Additional meetings
  5. Building code analysis.
  6. Accessibility or life safety reviews.

 

 

 

INFORMATION PROVIDED BY CLIENT

We shall be entitled to rely on the completeness and accuracy of all information provided by the Client or the Client’s consultants or representatives. The Client shall provide all information requested by Kimley- Horn during the project including, but not limited to, the following:

 

  1. Access to the site.

 

SCHEDULE

We will provide our services as expeditiously as practicable with the goal of meeting our mutually agreed upon schedule.
