REQUESTING DEPARTMENT: Budget

Please take notice of Park City Municipal Corporation’s (PCMC’s) intent to waive a competitive procurement process. PCMC Procurement Rule 5-3 provides that the competitive procurement requirements may be waived under circumstances where there is a reasonable justification and the waiver is in the best interests of PCMC.  The Procurement Official has determined that a waiver is appropriate for a contract for Project management for restoration of the Silver King mine in the amount of $200,000.00 to FOSMMH based on the information below:

Waiver Justification:
Awarding the contract through a Standard Procurement Process is impractical and not in the best interest of PCMC because procurement of the services is unlikely to produce competition. FOSMMH is the only vendor able to do the work on the Silver King mine and were active in the application process for this project.  

PCMC and FOSMMH submitted a joint application to Summit County for the Restaurant Tax Grant. This grant is to increase tourism and bring more visitors to Park City/Summit County. FOSMMH is actively working on a six-phase plan to restore the Silver King mine and open some of its structures to tourists. FOSMMH has completed Phase 1 and 2 and is in the process of completing Phase 3 in 2024. PCMC plans to contract with FOSMMH to use this grant money to continue the Silver King mine project by completing Phases IV and V in 2025. It is the opinion of PCMC that FOSMMH being actively engaged in the restoration and being a co-applicant on the grant that a procurement process would be impractical. PCMC recommends awarding the grant money received to FOSMMH.
