Public Notice of Proposed Waiver: Construction of a new Bubble to Cover the MARC Courts

  • Department:Recreation
  • Start Date:04/17/2024
  • Close Date:04/24/2024

DATE ISSUED: April 17, 2024

PROPOSED SERVICE: Construction of a new Bubble to cover the MARC courts.

PROPOSED PROVIDER: Broadwell

REQUESTING DEPARTMENT: Recreation

Please take notice of Park City Municipal Corporation’s (PCMC’s) intent to waive a competitive procurement process. PCMC Procurement Rule 5-3 provides that the competitive procurement requirements may be waived under circumstances where there is a reasonable justification and the waiver is in the best interests of PCMC.  The Procurement Official has determined that a waiver is appropriate for a contract for building a new dome to cover the outdoor courts in the amount of $410,000.00 est. to Broadwell Domes based on the information below:

Waiver Justification:

Awarding the contract through a Standard Procurement Process is impractical and not in the best interest of PCMC because a procurement process would be detrimental to the people of Park City and may delay construction of the dome until next year. This is an insurance replacement and the insurance company received bids for like for like replacement of the dome and PCMC determined that the proposal from Broadwell Domes best fit the needs of PCMC. The insurance company will be making this payment directly to Broadwell Domes so it is also not an expenditure of public funds since PCMC will only be paying the deductible to the insurance company of $25,000.00. This amount is below the amound needed and we only have one insurance company that we use which makes a purchase impractical.
