Please take notice of Park City Municipal Corporation’s (PCMC’s) intent to waive a competitive procurement process. PCMC Procurement Rule 5-3 provides that the competitive procurement requirements may be waived under circumstances where there is a reasonable justification and the waiver is in the best interests of PCMC. The Procurement Official has determined that a waiver is appropriate for a contract for Recycling Services in PCMC in the amount of $75,000.00 to Park City Conservation Association dba Recycle Utah based on the information below:
Waiver Justification:
The scope and complexity of services that PCMC seeks as well as the limited geographic scope makes it unlikely that a Standard Procurement Process would result in competition and would instead only increase cost and time for PCMC to acquire the services.
Recycle Utah has long provided these services. Recycle Utah understands what services are needed, how to communicate with the public, and how to manage the recycling services efficiently and effectively.
Recycle Utah a 501(c)(3) has had a special service contract with PCMC for multiple years. We are continuing with that contract for an additional 6 months. Recycle Utah has been a partner to PCMC and there are no other non-profit organizations that we are aware of that could fill this spot.
Additionally, awarding the contract without engaging in a Standard Procurement Process is in the best interest of PCMC because a cost-benefit analysis demonstrates that transitional costs of changing to another provider are unreasonable or cost-prohibitive. Recycle Utah has run the recycling center since 1995 and is the recognized and beloved leader in recycling and promoting sustainable lifestyle in Park City. The facility, in addition to City and County funding, relies heavily on donations to run this voluntary drop-off site that is free for Park City and Summit County residents. Partnering with a private vendor would require public agencies to fully fund the organization, which would be cost prohibitive.
Recycle Utah – SCOPE OF SERVICES
Management and operations of a community drop-off location and events for landfill diversion services
- Management of the Recycle Center for single stream recycling, items not included in curbside recycling, and hard-to-recycle items.
- Two (2) annual Household Hazardous Waste Events.
- Two (2) Dumpster Days events, lasting 3 days each for a total of 6 days annually.
- Operation of a thrift store
Community outreach and education
- In-class or virtual education sessions for K-12 students in Park City about sustainable living.
- Collaboration with PCMC teams on outreach and education.
- Two (2) annual cleanup days with support from the Park City Parks Department.
- Support two (2) additional community cleanup days and loan of trash pickers.
- Green Business development activities in collaboration with PCMC and other key partners.
